1. Definitions

In these Terms and Conditions:

  • "We," "Us," "Our" refers to Khwan Suan, a senior care facility located at 23/5 Moo 2, Bang Saray, Sattahip, Chonburi 20250, Thailand
  • "Services" refers to our Assisted Daily Living Residence, Social Engagement Program, Family Transition Support Package, and related care services
  • "Resident" refers to an individual enrolled in our residential care program
  • "Participant" refers to an individual enrolled in our Social Engagement Program
  • "Client" refers to the individual or family member entering into an agreement for services
  • "Agreement" refers to the contract between Khwan Suan and the Client for specific services

2. Acceptance of Terms

By engaging our services, visiting our facility, or using our website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services or website.

To enter into an agreement with Khwan Suan, you must be at least 18 years of age and have the legal capacity to enter into binding contracts under Thai law.

3. Service Description

Khwan Suan provides the following services:

3.1 Assisted Daily Living Residence

A residential care program providing private accommodation, daily living support, meal preparation, housekeeping, and access to communal areas. This service is designed for older adults who benefit from gentle assistance with daily activities.

3.2 Social Engagement Program

A community-based program offering weekly social activities, group outings, creative workshops, and intergenerational events for seniors who wish to maintain active social lives.

3.3 Family Transition Support Package

A comprehensive support package assisting families during the transition to supported living arrangements, including consultations, settling-in support, and ongoing communication.

Service availability, features, and pricing are subject to change. Current offerings and fees are detailed on our website and in individual service agreements.

4. Enrollment and Admission

Enrollment in our services requires:

  • Completion of an initial consultation to assess needs and suitability
  • Provision of required documentation including health information, contact details, and emergency contacts
  • Agreement to these Terms and Conditions and signing of a service-specific agreement
  • Payment of required deposits or advance fees as specified in the service agreement

We reserve the right to decline enrollment if we determine that our services are not appropriate for an individual's needs or if we are unable to provide adequate care.

5. Payment Terms

5.1 Fees and Pricing

Service fees are as follows:

  • Assisted Daily Living Residence: ฿14,000 per month
  • Social Engagement Program: ฿4,500 per month
  • Family Transition Support Package: ฿58,000 for a three-month period

5.2 Payment Schedule

Monthly fees are due on the first day of each month. Payment must be received within 5 business days of the due date. Late payments may result in service suspension or termination.

5.3 Payment Methods

We accept payment via bank transfer, cash, or other methods as agreed upon. All fees are quoted in Thai Baht (฿).

5.4 Fee Adjustments

We reserve the right to adjust fees with 60 days written notice. Existing clients will be informed of any changes in advance.

6. Cancellation and Refund Policy

6.1 Residential Care

Clients wishing to terminate residential care must provide 30 days written notice. Fees paid for the notice period are non-refundable. Any advance payments beyond the notice period will be refunded within 14 business days.

6.2 Social Engagement Program

Clients may cancel participation with 14 days written notice. The current month's fee is non-refundable, but no further charges will be applied.

6.3 Transition Support Package

As this is a time-limited package, cancellations after services have commenced will result in prorated charges based on services already delivered. Unused portions may be refunded at our discretion.

7. Client and Family Responsibilities

Clients and their families agree to:

  • Provide accurate and complete information during enrollment and throughout service provision
  • Inform us promptly of any changes in health status, needs, or circumstances
  • Treat staff, other residents/participants, and facility property with respect
  • Pay fees on time according to the agreed schedule
  • Comply with facility rules and guidelines designed to ensure safety and wellbeing
  • Participate in care planning discussions and review meetings
  • Maintain appropriate behavior that does not endanger or disturb others

8. Our Responsibilities and Service Limitations

Khwan Suan commits to:

  • Provide services with reasonable care and skill
  • Maintain appropriate staffing levels to deliver agreed services
  • Respect the dignity, privacy, and preferences of residents and participants
  • Maintain safe and clean facilities
  • Communicate openly with clients and families

However, please note:

  • We are not a medical facility and do not provide medical treatment or nursing care
  • While we support wellbeing, we cannot guarantee specific health outcomes
  • We reserve the right to modify programs or activities based on circumstances, safety considerations, or staffing availability
  • In emergency situations, we will act in the best interests of residents, which may include contacting emergency services or family members

9. Termination of Services

We may terminate services immediately if:

  • Payment obligations are not met after reasonable notice
  • A resident or participant engages in behavior that endangers themselves or others
  • Care needs exceed our capacity to provide appropriate support
  • There is a material breach of these terms or the service agreement
  • Mutual respect between staff and clients cannot be maintained

10. Limitation of Liability

To the fullest extent permitted by Thai law:

  • Our liability for any claim arising from our services shall not exceed the fees paid by the client for the services in question
  • We are not liable for indirect, consequential, or incidental damages
  • We are not responsible for personal property loss, damage, or theft unless caused by our negligence
  • We are not liable for health outcomes or conditions beyond our control

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or other liability that cannot be limited by law.

11. Privacy and Confidentiality

We respect your privacy and handle personal data in accordance with our Privacy Policy and Thailand's Personal Data Protection Act. All care-related information is treated as confidential and shared only with authorized individuals. Please review our Privacy Policy for detailed information.

12. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Thailand. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Chonburi Province, Thailand.

Before pursuing legal action, we encourage clients to contact us directly to attempt to resolve any concerns through good-faith discussion.

13. Changes to Terms

We may update these Terms and Conditions from time to time. Significant changes will be communicated to active clients. Continued use of our services after changes take effect constitutes acceptance of the revised terms. The current version will always be available on our website with the date of last update.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable under Thai law, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if that is not possible, it shall be severed from these terms. The remaining provisions shall continue in full force and effect.
